Are official "guidelines" binding?

The guidelines are not statutory. The difference between statutory regulations and guidelines is that statutory instruments are laid before Parliament and become law, whereas a guideline is not enforceable in a court. Still, it is certainly very persuasive.

If a bailiff or an authority breaches a guideline, then you have a strong case to argue that it must be followed.

A recent judicial review, R (on the application of Purnell) v South Western Magistrates' Court [2013] EWHC 64 (Admin), required South Western Magistrates' Court to follow its own court guidelines when administering a case.

You can quote this case if a bailiff or an authority says it is not obligated to follow an official guideline.
