Using bolt cutters or a lobster rebar cutter, sever the padlock chain. Leave the remaining two chains intact. Disc cutters are noisy and throw sparks.
Pull the clamp from the wheel.
Be careful not to snag the chain on the brake hoses.
These have multiple locks. Drill the centre of each lock with a 3mm cobalt pilot drill bit.
Drill out the remaining lock using a 12mm cobalt drill on a slow speed.
The device dismantles into three parts.
You can call an emergency locksmith which costs about £300 + VAT. You can reclaim this from the creditor whose behalf the bailiff is acting for.
Liability for wrongful action by an enforcement agent resides with the creditor. See Paragraph 7 of the Taking Control of Goods: National Standards 2014.
Let down the tyre and lift off the clamp.
You have to let down the tyre first, then the clamp can be safely removed from the wheel.
You are not guilty of "interfering with controlled goods" under Paragraph 68 of Schedule 12 of the Tribunals Courts and Enforcement Act 2007, because the vehicle (the goods) has not been secured, and therefore is not controlled goods under regulation 13(1) of the Taking Control of Goods Regulations 2013. See R v Lambert [2019].
