Example Fees for a High Court Enforcement Officer

In this example the HCEO is recovering a Transferred County Court Judgment of £2000.

Note: The creditor pays a £60 transfer fee to the HCEO, but the regulations do not provide for this sum to be passed on to the defaulter.

• Original debt = £2000

• HCEO attends, he adds his fee for execution of the writ of control under Rule 1 of Schedule 3 being 5% on the first £100 and 2.5% on the remaining £1900 – total fee is: £52.50 plus VAT (£10.50) being – £63.00.

• If the HCEO has removed goods, then fixed fees under Rules 2 to 11 may also apply.

• If the HCEO does not take possession of your goods then all you are liable for including the HCEO fee is: £2063.00

Note: If you did not pay the debt then writ is not executed and there is no fee. If you only partially pay the debt then only the actual sum recovered carries Rule 1 execution fee.
